Ferrero loses trade mark dispute in Ukraine

24 January 2011 – The Higher Economic Court of Ukraine has cancelled the protections given to Soremartec, a part of the Ferrero Group, of the intellectual property right to the trademark protecting the appearance of Raffaello.

A statement from Soremartec reads, “Ferrero is alarmed by the fact that important rulings by Ukrainian courts are issued for cases on the protection of intellectual property, but these are heard by judges that are not specialists in the intellectual property law field.” It concludes that the ruling would encourage third parties to take advantage of the reputation and know-how of foreign investors in Ukraine.

The case has continued through several claims and appeals since a counter-claim of Russia’s CJSC Landrin, which uses a similar trademark for its Landrin Waferatto Classics sweets.
