Mars and Hershey in orange dispute

Mars and Hershey are once again to face each other in court. Hershey is suing Mars, alleging that Mars’ packaging of its Dove peanut butter confectionery mimics the packaging of Hershey’s Reese’s Peanut Butter Cups and Reese’s Pieces brands, specifically over the use of orange as the main colour. Hershey is claiming trademark dilution, infringement and unfair competition. In response, Mars has counter-sued stating that orange is commonly associated with peanut-based confectionery.
